Working Safely and FAA Part 107

When working with us, you may hear us use the term "Part 107".  Here is some information on the rules we need to adhere to in order to provide drone services both residentially and commercially.

FAA Part 107 Regulations

FAA Part 107 is a set of rules and regulations governing the commercial use of small unmanned aircraft systems (sUAS), commonly known as drones. To fly a drone commercially in the United States, pilots must obtain a remote pilot certificate from the FAA by passing a knowledge test. The test covers a range of topics, including airspace classification and operating requirements, weather and loading, emergency procedures, and drone maintenance. The Part 107 certification process helps ensure that drone operators have the necessary knowledge and skills to operate drones safely and responsibly. It also helps to protect people and property on the ground, as well as other airspace users such as manned aircraft.  All Nitescape LLC pilots have qualified and are licensed under Part 107.

Rules Summary

The basic guidelines of Part 107 are:

  1. The drone must weigh less than 55 pounds.

  2. The drone must be flown in daylight or during twilight (30 minutes before sunrise or 30 minutes after sunset).

  3. The drone must be flown within visual line-of-sight of the operator.

  4. The drone must not be flown over people not directly participating in the operation.

  5. The drone must not be flown higher than 400 feet above ground level (AGL) or, if higher than 400 feet AGL, within 400 feet of a structure.

  6. The drone must not be flown faster than 100 mph.

  7. The drone must yield right of way to manned aircraft.

  8. The drone operator must have a remote pilot certificate and pass an FAA-approved knowledge test.

  9. The drone must not be flown from a moving vehicle unless the operation takes place in a sparsely populated area.

  10. The drone must not be flown in a manner that interferes with any manned aircraft or emergency response activities.

It is important to note that there are additional rules and requirements that must be followed in order to operate a drone commercially under Part 107, and it is the responsibility of the drone operator to ensure that they are in compliance with all applicable regulations.
